Judge rejects Trump administration bid to dismiss NAACP lawsuit over Musk’s Colossus data centre

·

A US federal judge has rejected the Trump administration's argument that the Environmental Protection Agency can unilaterally dismiss citizen lawsuits under the Clean Air Act, keeping alive an NAACP case against Elon Musk's AI company over pollution from its Colossus data centre in Memphis, Ars Technica reports.

The NAACP sued after unpermitted gas turbines were found powering the site, run by the company formerly known as xAI and now called SpaceXAI. It wants pollution controls on the turbines and penalties.

The administration intervened, arguing the suit did not serve the public interest. District Judge Debra Brown ruled on Tuesday that nothing in the act lets the EPA administrator dismiss a citizen suit. Earthjustice, which supports the case, welcomed the ruling and accused the administration of trying to shield Musk's company.
