A federal appeals court has signalled doubts about a Justice Department lawsuit seeking to stop California counting mail-in ballots sent to people the government says are likely noncitizens, Al Jazeera reports, citing Reuters.
At an unusual Sunday hearing, Circuit Judge Mark Bennett, a Trump appointee, said the requested injunction appeared to conflict with state law passed under the Constitution's Elections Clause, which gives states control of how elections are run. He said the three-judge panel would rule as quickly as possible.
The Justice Department filed its complaint on 15 October and has given California a list of 20,000 names it says are ineligible to vote. Critics say the administration is trying to sow confusion before the 3 November midterm elections.
