An adviser to the EU's top court has said Google's Gemini chatbot may infringe the rights of press publishers when it reuses their articles to answer users' questions, according to a Reuters report carried by Daily Maverick. Advocate General Maciej Szpunar gave the opinion in a case brought by Hungarian website operator Like Company against Google at the Court of Justice of the European Union in Luxembourg.
He said infringement could arise where a chatbot gets round paywalls or other barriers, or reproduces a publication's wording in a recognisable way, though facts themselves are not protected. He also said that training AI models on such material is allowed under the EU's text and data mining exception, and found no evidence that Google had trained Gemini on the Hungarian publisher's articles. The court usually follows such opinions and will rule in the coming months.
