A British photographer living in Sweden faces deportation that would separate him from his 16-month-old son, The Guardian reports.
Simon Montgomery moved to Sweden after Brexit, so had no residence rights under the withdrawal agreement. He applied to stay as the father of an EU citizen, as his son holds German citizenship through his mother, but the migration agency refused last December, saying there was no proof he provided actual care and that he could visit visa-free. A migration court upheld the decision this month, ruling that the state's interest in controlled immigration outweighed his case.
Montgomery, who separated from the boy's mother soon after the birth, shares legal custody and says he looks after his son three days a week. He is appealing to the higher migration court and says he cannot visit relatives in Britain for fear of being refused re-entry.
