A senior aide to Jeanine Pirro, the US attorney for Washington DC, admitted in a phone call that prosecutors had made a serious mistake in their case against two former FBI officials, an agent testified on Thursday, NBC News reports.
Nikki Floris and Bradley Benavides were charged last week with lying to Congress about what they knew of an investigation into Hunter Biden's laptop. Special Agent Ryan Witt told a preliminary hearing that his sworn affidavit wrongly cited a congressional staffer as having been present for both officials' testimony, when he attended only one.
Witt said Pirro aide Carlton Davis acknowledged the error on a call on Monday. Prosecutors then filed a new complaint and affidavit that no officer or judge had signed, and Magistrate Judge Zia Faruqui threw it out on Tuesday.
