Canada's top court has sent back for retrial the case of a driver who was cleared of dangerous driving after a crash in Vancouver that killed an 18-month-old girl, CTV News reports, citing The Canadian Press.
Moshfeghi Zadeh drove through a red light at a busy intersection in July 2021 and hit another vehicle, and his car flipped onto the pavement. The child's father was seriously injured.
The trial judge had found that his driving did not amount to a marked departure from what a reasonable person would do in the circumstances, and acquitted him of dangerous driving causing death and causing bodily harm. A majority of the British Columbia Court of Appeal then rejected the Crown's appeal. The country's highest court has now overturned those outcomes, meaning the case will be heard again.
